Martha was apparently put off enough by him killing turtlenecks and frightened by the stunt with the Little Folk to flip her support, although getting the death sentence suspended might have been a concession she extracted.
While she was probably there, she might not have even been there. I don't think we even know for certain that she's alive. I would think Jim would have mentioned if she were dead.
